2. Visiting this website
Our hosting provider automatically logs your IP address, the date and time, the page requested, the referring page and your browser type. We use this to deliver the website and keep it secure (Art. 6(1)(f) GDPR).
The website loads fonts from Google (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland), which transmits your IP address to Google. Our legitimate interest is a consistent presentation of the website (Art. 6(1)(f) GDPR).
3. Requesting a call
We process your name, email address, phone number and LinkedIn profile URL to set up and prepare your call (Art. 6(1)(b) GDPR). Providing this data is voluntary, but without it we cannot call you or introduce you to anyone. Tess is for people aged 18 and over.
4. Your LinkedIn profile
With your consent (Art. 6(1)(a) GDPR), we retrieve the information on your LinkedIn profile (name, headline, roles, education, skills, languages, location and recent activity) and summarise it so that Tess can prepare for your call.
5. Your call with Tess
Tess is an AI. With your consent (Art. 6(1)(a) GDPR), we record and transcribe the call, which runs on speech recognition, a language model and speech synthesis. You can withdraw your consent at any time, including during the call. Please don't share health or other sensitive information (Art. 9 GDPR); if you do, we leave it out of your match profile.
From the call we create a match profile (profiling): your current situation, the kind of person who would help you, what you could offer others, and how you like to meet (Art. 6(1)(a) and (b) GDPR).
We also use pseudonymised transcripts and match profiles to improve Tess. Our legitimate interest is a service that understands people correctly and makes better introductions (Art. 6(1)(f) GDPR).
6. Matching and introductions
We compare your match profile only with those of other members of your network (Art. 6(1)(b) GDPR). Before both sides agree, we describe your situation to the other person without your name. Only once you both agree do we share your names and email addresses (Art. 6(1)(a) GDPR).
If your network stops using Tess, we delete your profile, unless you have agreed that we may keep it and contact you by email about Tess (Art. 6(1)(a) GDPR).
7. Business contacts
If you contact us on behalf of an organisation, we process your details to reply (Art. 6(1)(b) GDPR, or Art. 6(1)(f) GDPR based on our interest in responding to enquiries). We may also contact people at organisations that could use Tess, using names, roles and business contact details from public sources such as company websites and LinkedIn. Our legitimate interest is developing business relationships (Art. 6(1)(f) GDPR).
8. Recipients and transfers
We use service providers for hosting, forms, telephony, speech technology, language models, data storage and email, all bound by data processing agreements (Art. 28 GDPR). Otherwise, your data only goes to other members as described in section 6, or to authorities where we are legally required to disclose it.
Some providers process data outside the EU, for example in the USA. We only use them on the basis of an EU adequacy decision, such as the EU-U.S. Data Privacy Framework, or EU Standard Contractual Clauses, a copy of which you can request.
9. Retention
Log files: 7 days. Call recordings and transcripts: 90 days after the call. Pseudonymised data used to improve Tess: 24 months. Request details, LinkedIn summary and match profile: until you ask us to delete them, 12 months after your last interaction with Tess, or until your network stops using Tess. Records of consents and introductions: 3 years, so that we can prove them (Art. 6(1)(c) in conjunction with Art. 7(1) GDPR). Business enquiries and business contacts: 2 years after our last contact; if you object to being contacted, we keep only a note so that we don't contact you again. Contracts and invoices are kept for the periods required by commercial and tax law.
10. Your rights
You have the right to access, rectification, erasure, restriction of processing and data portability (Art. 15–18 and 20 GDPR), and you can withdraw your consent at any time with effect for the future. To exercise these rights, email cf@clara-funke.de. You can also lodge a complaint with a supervisory authority, for example the Berliner Beauftragte für Datenschutz und Informationsfreiheit, Alt-Moabit 59–61, 10555 Berlin.
Right to object (Art. 21 GDPR): You can object at any time, on grounds relating to your particular situation, to processing based on Art. 6(1)(f) GDPR. You can object to direct marketing at any time without giving reasons.
